Terms & Conditions for Using Plastnofy
Welcome to Plastnofy! These Terms of Use (“Terms”) govern your access to and use of Plastnofy, our sustainable cleaning mobile application (the “App”), and related services provided by Plastno Inc. (“we,” “our,” or “us”). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, do not use the App.
Acknowledgement
These Terms and End-User License Agreement (“Agreement”) are between you and Plastno Inc., not Apple or Google. Apple and Google are not responsible for the App or its content. By using the App, you acknowledge that you have read, understood, and agree to abide by these Terms.
Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
Scope of License
Plastno Inc. grants you a non-exclusive, non-transferable, revocable, limited license to install and use the App on mobile devices you own or control, subject to the applicable platform terms:
(a) On Apple devices, use of the App is governed by the Apple Media Services Terms and Conditions.
(b) On Android devices, use of the App is governed by the Google Play Terms of Service.
This license does not permit you to distribute, sublicense, lease, or make the App available over a network where it could be used by multiple devices simultaneously. You may not copy, modify, reverse-engineer, or create derivative works of the App.
Maintenance and Support
Plastno Inc. is solely responsible for providing maintenance and support for the App. Apple and Google have no obligation to provide maintenance or support services for the App.
Warranty
The App is provided "as is" without warranties of any kind. Plastno Inc. disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Plastno Inc. also disclaims responsibility for any issues caused by the hardware or operating system of your device. Neither Apple nor Google provides any warranty for the App.
Product Claims
Plastno Inc. is responsible for addressing any claims related to the App, including but not limited to product liability claims, claims that the App fails to conform to legal or regulatory requirements, or claims arising under consumer protection laws. Neither Apple nor Google is responsible for addressing any claims related to the App.
User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and ensuring all activities under your account comply with these Terms. Misuse, unauthorized access, or malicious activity is strictly prohibited.
Use of Services
The App is designed to assist with sustainable home cleaning, supply management, and waste disposal guidance. You agree to:
(a) Use the App solely for its intended purpose and in compliance with all applicable laws and regulations.
(b) Not submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
(c) Not attempt to reverse-engineer, decompile, disassemble, or extract the source code of the App or its AI systems.
(d) Not use automated systems, scripts, bots, or scrapers to interact with the App's features or AI services.
(e) Not deliberately submit misleading, false, or malicious inputs to the AI system with the intent of generating harmful, dangerous, or deceptive recommendations.
(f) Not interfere with or disrupt the App's servers, networks, security features, or infrastructure.
(g) Not use the App to collect personal information about other users without their consent.
(h) Not share your account credentials with any third party or allow unauthorized access to your account.
Subscription and Payment
The App offers subscription-based plans ("Premium" and "Basic") that provide access to enhanced features, including unlimited AI-powered scans and advanced cleaning insights.
(a) Free Trial. We may offer a free trial period for new subscribers. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the price displayed at the time of enrollment.
(b) Auto-Renewal. All subscriptions automatically renew at the end of each billing period (monthly or annually, as applicable) unless you cancel at least 24 hours before the end of the current period.
(c) Billing. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
(d) Cancellation. You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
(e) Price Changes. We may change subscription prices from time to time. Price changes will take effect at the start of the next billing period following the date of the price change. Your continued use of the App after the price change constitutes your agreement to pay the updated amount.
(f) Free Tier. The App offers a free tier with limited functionality (a set number of AI scans per category per month). Free tier limitations may be modified at our discretion.
(g) Household Premium. If a Primary Owner of a household within the App holds an active premium subscription, that subscription's benefits may extend to all members of the associated household ("Household Premium"). Household Premium access is contingent upon the Primary Owner maintaining an active paid subscription. If the Primary Owner cancels or their subscription expires, Household Premium access for all members will revert to the free tier at the end of the Primary Owner's billing period.
(h) Refunds. Refund eligibility is subject to the refund policies of the applicable platform (Apple App Store or Google Play). Plastno Inc. does not process refunds directly.
AI-Powered Features
The App utilizes artificial intelligence ("AI") powered by Google's Gemini models, accessed through Firebase Cloud Functions, to provide cleaning analysis, supply identification, waste disposal guidance, product sustainability assessments, and conversational assistance. You acknowledge and agree that:
(a) AI-generated content is provided for informational and educational purposes only and does not constitute professional cleaning, health, environmental, or safety advice.
(b) AI outputs may be inaccurate, incomplete, or contextually inappropriate. You are solely responsible for evaluating and acting upon any AI-generated recommendations.
(c) You will not rely on AI-generated guidance for the handling of hazardous materials, chemical mixing, or any activity that could result in personal injury or property damage without independent verification from a qualified professional.
(d) We do not guarantee the accuracy, reliability, or completeness of any AI-generated content, and we expressly disclaim all liability arising from your reliance on such content.
(e) AI-powered features require an active internet connection and may be subject to temporary unavailability due to maintenance, server load, or third-party service disruptions.
User-Generated Content
By uploading photos, text, or other content ("User Content") to the App, you grant Plastno Inc. a non-exclusive, worldwide, royalty-free, sublicensable license to use, process, store, and transmit your User Content solely for the purpose of providing and improving the App's services, including AI-powered analysis and personalized recommendations.
You retain all ownership rights in your User Content. We do not claim ownership of any content you submit. We will not use your User Content for advertising or marketing purposes without your express consent.
You represent and warrant that:
(a) You have all necessary rights to submit your User Content.
(b) Your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
(c) Your User Content does not contain any material that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Your use of the App is governed by our Privacy Policy, available at https://www.plastnofy.com/privacy, which is hereby incorporated into these Terms by reference. By using the App, you acknowledge that you have reviewed and agree to the data collection and processing practices described in our Privacy Policy.
Without limiting the foregoing, you specifically acknowledge that:
(a) Photos, text, and contextual household data you submit through the App may be processed by third-party AI services (Google Gemini) to provide the App's core features.
(b) Your subscription status may be shared with email marketing platforms (Klaviyo) to personalize communications.
(c) App usage events may be collected by advertising attribution services (Meta/Facebook) for campaign measurement, subject to your App Tracking Transparency preferences on iOS.
(d) Your data is stored and processed using cloud infrastructure services (Firebase/Google Cloud) and subscription management platforms (RevenueCat).
You retain ownership of your data but grant us the necessary licenses to process it as required for delivering and improving the App's services.
Intellectual Property
All intellectual property rights in and to the App are owned by Plastno Inc. and are protected by applicable laws. You are granted a limited license to use the App for its intended purpose but may not modify, distribute, or reproduce any part of it without permission.
Legal Compliance
You agree to use the App in compliance with all applicable laws and regulations.

Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the App, such as your wireless service provider’s terms.
Third-Party Beneficiary
You acknowledge and agree that Apple and Google, and their subsidiaries, are third-party beneficiaries of this Agreement and have the right to enforce it.
Limitation of Liability
The App is provided "as is" without warranties of any kind. Plastno Inc. disclaims all liability for any indirect, incidental, or consequential damages resulting from the use of the App, to the extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Plastno Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your User Content; or (e) your infringement of any intellectual property or other rights of any third party.
Termination of Service
We reserve the right to terminate or suspend your access to the App at our discretion, including for violations of these Terms or non-payment of fees.
Account Deletion
You may delete your account at any time through the App's Account settings. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy. Certain data may be retained as required by law, for legitimate business purposes, or to complete any transactions that were initiated prior to the deletion request. For additional information, please review the "Account and Data Deletion" section of our Privacy Policy.
Modifications to Terms
We reserve the right to update or modify these Terms at any time. Continued use of the App after changes indicates acceptance of the updated terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of Delaware, United States. If you access the App outside the United States, you are responsible for compliance with local laws. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
Severability and Survival
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
The following sections shall survive any termination or expiration of these Terms: Intellectual Property, Warranty, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and this Severability and Survival section.
Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall first be resolved through informal negotiation. You agree to contact us at [email protected] and provide a written description of the dispute before initiating any formal proceedings. We will attempt to resolve the dispute within thirty (30) calendar days.
If the dispute cannot be resolved informally, you agree that it shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, conducted in the State of Delaware, United States. The arbitration shall be conducted by a single arbitrator, and the arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
CLASS ACTION WAIVER: YOU AND PLASTNO INC. AGREE THAT ANY CLAIMS SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
EXCEPTIONS: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
OPT-OUT: You may opt out of this arbitration agreement by sending written notice to [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of arbitration.
INTERNATIONAL USERS: If you are a resident of the United Kingdom, European Union (including Ireland), Australia, New Zealand, or Singapore, nothing in this Dispute Resolution section limits your statutory consumer rights or your right to bring claims before the courts or tribunals of your country of residence. The arbitration clause and class action waiver above apply only to the extent permitted by the laws of your jurisdiction.
